A Supreme Court bench led by Chief Justice DY Chandrachud, dismissed a PIL requesting policies for menstrual leave, stating it is a government policy matter. The court emphasized that while such policies might benefit women, they could also lead to unintended disadvantages, such as women being excluded from the workforce. The Ministry of Women and Child Development has been directed to consult stakeholders to consider framing a model policy. The PIL had sought the implementation of menstrual leave under the Maternity Benefit Act.
Do you believe implementing menstrual leave policies would be beneficial?
