The Allahabad High Court granted bail to a rape accused on March 11, 2025, with Justice Sanjay Kumar Singh stating, “This court is of the view that even if the allegation of the victim is accepted as true, then also it can be concluded she herself invited trouble and was also responsible for the same. Similar stand has been taken by the victim in her statement. In her medical examination, the doctor did not give any opinion about the sexual assault.” The case involved a postgraduate student who alleged the accused raped her twice after she agreed to rest at his place while intoxicated.
The court further noted, “being an MA student, the woman was competent enough to understand the morality and significance of her act.” The accused’s counsel argued it was a consensual relationship, not rape, and highlighted his detention since December 2024 without prior criminal history. The state opposed the bail but couldn’t dispute the facts presented.
The decision, based on the FIR and evidence, has drawn attention. No further appeals were reported as of April 10, 2025.
