Breaking in,’Lying On Woman’, Sm*thering Her Cries – Not Attempt to R*pe If No Direct Act Towards Penetration: Patna HC

Patna High Court Rules Lying on Victim Falls Short of ‘Attempt to Rape’

The Patna High Court modified an accused man’s conviction from attempted rape to outraging modesty, holding that entering a woman’s home, lying on top of her, and smothering her mouth constituted preparation rather than a direct act toward penetration. Modifying the 2013 trial court verdict, the bench reduced the four-year prison sentence to the 2.5 months already served and ordered ₹25,000 in victim compensation.
